It's my turn :(

Y'all!

As abt 2.5 hours ago my Solara has been hit. :(

The car is still driveable but my passenger door needs to be replaced.

It was raining and I just cruising around 30 mph (I am not lying!)
Suddenly there is a 300E (who failed to stop/yield), T-boned my baby.

I was spinning 210 degree before end up in the curb facing the other side.

The Benz driver, told me he was stopping and
accused me that I was speeding and hit him.

Police came and write down everything that I said and
what the other guy said. (darn liar!)

The Cop said that he could not said who's fault since
he did not witness the accident.

I am abt. to call his insurance and keep y'all updated.
I took some pics as well, so I'll post it sometimes tonite.

Rite now I am just sad that my baby is hurt. :(

He has no case, obviously he hit your passenger side door, he's at fault. Jon

That's too bad happy_aggies, you had my vote for the nicest Solara on the road. At least you're ok and the car is repairable. Good luck fighting with the insurance companies.

my dad always said it doesn't matter, whoever hits you pays, the only other reason I could think you would pay is if you didn't yield, but reading your story it doesn't even apply...you should be fine, sorry to hear the news that sucks

Dude, that is not cool. Well at least someone with some cash hit you. I hope you can get this resolved quickly, as you have one of the best cars on here!
Let's just pretend I didn't grow up, or you're going to be terribly disappointed.

it should automatically be his fault b/c you had the straight away and he failed to stop/yield (at least that's MA law which is why i didn't have to pay for my accident even though i technically hit her)

even if he was coming out of the street and you clipped him, most states he'd be found at fault under normal circumstances.

so...
a) he hit you
b) you had the straight away
c) he didn't stop or yield into on-coming traffic

but who cares!! the poor solara!! poor you! and that beautiful color! i hope they can match it perfectly!

thank goodness you're ok though! like everyone said..that's the important part..cars can be replaced

Because you were both moving at the time, a certain percentage may go to your insurance. Hopefully only a small amount. It's true, that if you were hit on the side, the other driver should have had control of their vehicle, and therefore, it's their fault. When you get a copy of the police report, look it over well, and make sure all numbers and codes are accurate; if not, get it ammended. When it comes down to it, it's your word against his, so the insurance company looks at the location of the damage and makes a determination of fault based on that. At least that's the way it is in NY. Any accident you can walk away from is a minor one. You'll get it repaired and life goes on. Good luck.

Man, that's bad news! Like everyone else here, I think your car is beautiful. Glad to hear that you're OK. From the way you described the accident, it would seem to be an open and shut case as to who is at fault. Insurance companies may not see it that way, so good luck. I hope you'll be able to get the right paint match when the repair work is done.

Sorry to hear about your car

Nobody else on the road saw what happened? I saw a collision happen right in front of me one time and because of what I told the cop it pretty much eradicated any doubt of who was at fault..

OMG!! and no one was hurt? wow..you're gonna need more than the door replaced b/c the back frame part is damaged too :( if you have side airbags, did they go off?

sure...i believe that guy that it was your fault by looking at the damage and situtation

i'm almost 150% positive that he'll be found at fault.

(did you mean 1145am?) i'm guessing you had a digital camera on hand? i'm surprised that guy didn't bust your balls bout taking a pic of his car.

those pictures hurt to look at!! (haha..we should start a gallery of smashed up solaras..there's already a handful of pics we could put in it  )
