Yea, chances are you wont be caught and if you do its just a $44 fix it ticket (in NJ atleast) but its also a lot of extra work.

Essentially you are going to pull another power from the battery and put that on a switch. Run a wire from a constant power, but one that shuts off with your car so you dont leave your fogs on, like your windshield wipers. Run a wire from there to a switch and then connect that wire to the power wire of your fogs. Now when you flip the switch you actually bypass the headlight switch. If your new switch is in the off position the fogs will still turn on if you tell them to on your headlight stalk switch.

The only thing to watch out for and i'll have to check is the amperage of the fogs. Hopefully it isn't too high that you'll blow your windshield wiper fuse

the fogs run through a relay (i think), so you would'nt be pulling high amperages if you hook your switch up to your wiper wires.

With the stock setup they may run through a relay. But with the method i described, if you chose to turn them on without headlight power, you'd have to pull power from somewhere else. Thats why i mentioned the windshield wipers. That is one of the very few circuits that shuts off with the car.
