Arbitration - lemon law related

Postby bigpow » Mon Nov 24, 2003 11:45 am

For all of you that had gone / are going / are planning through arbitration (exercising lemon law), could you please post your experience/process/hints here?

- What are the requirements?
- What is the process?
- How long does it take?
- Are there any hidden fees?
- What car would you get next?
- Does it leave record on your credit history?

Thanks!

PS: I know this is a Toyota forum, not a KIA forum
(Not necessaryly pertain to '04 Solara)

Each state is different. Check out the website for your state's Attorney Generals office. Ohio gives you step by step details on their website.

Which way is the best?
1. Documents only
2. Oral Hearing
3. Teleconference call

What do you mean by best. It all depends on your situation. Choose the option that you think you'll have more leverage in. For example, if you believe that the documents you have are absolutely going to guarantee you a slam dunk, then documents only. Downside is providing an effective amount of paperwork before the arbitrator starts getting annoyed and tired from reading useless papers. If you're a people-person, then oral hearing may be your choice. IMHO, it's dependent upon the party.

Thanks. I'll stick with docs only since English is not my native language.
I have all the docs from all four dealer failed attempts, I hope those will do.

it depends on the state you're in. I'm pretty sure there are different requirements.

I just checked ask.com (gotta luv that ask jeeves!!) and found this site...
http://www.lemonlaw-attorneys.com/page2.html

this one has some good tips:
http://lemonauto.com/lemonlaw_california.htm?GTSE=goog>KW=california+lemon+law
LEMON LAW TIPS
--------------------------------------------------------------------------------
DO NOT leave the dealership without your repair order (no repair order means no proof of repair).

• Make sure the repair order accurately reflects the date you dropped off the vehicle for repair and the date you picked up the vehicle when the repairs were completed.

• Make sure the dealership accurately describes your complaints in your words, not the dealership's words.

• Save all your repair orders.

• Ignore the dealership and the manufacturer if they tell you that you do not have a lemon law claim.

My Girlfriend won a case with Universal City Nissan (LA) last year. She had an Altima 03' that had 6 problems within 5 months of purchase. She had her car 3 months out of those 5 because of repairs. Long story short, she won and now she drives an 04 Maxima. Nissan refunded all her money and since they were so nice about the whole thing they gave her a killer deal on any car of her choice. It took alot of patience but just be persistant and don't forget to bother all the people you need to get your point across and get things done!
Yeah, I've owned 2 Solaras so.............................Image

Wow!

That's very encouraging...

I think I might try the 4Runner if Toyota does the same thing to me
(fingers crossed)
