I got a ticket just last week for doing 51 in a 35. It's just easier to mail in the money and forget about it. Try to find out if you can get in a drivers course so you don't get points on your license so your insurance doesn't go up. If you can't do that then I guess you're just SOL and have to stick with the points. I wouldn't fight it though cuz you'll probably just be wasting your time and money.

Ticket

Postby jim@foreignaffairs » Thu Jun 10, 2004 8:41 am

The answer to your question depends on your driving record. If it is bad, it can be cheeper to just pay the ticket as I have seen judges fine a driver even more than the bail!. If your record is not bad, you can fight it and get a reduced fine, and if the police officer doesn't show, you will be let off the hook. If the cop does show you will be found guilty no matter what. At least that's how it works here. The worst part however is the rise in insurance cost if your insurance carrier finds out. So don't be stupid enough to as them how this ticket will affect your rates, chances are they won't know you got a ticket unless you alert them to the fact or you have such a bad record they check on a regular basis. Good luck.

Did he show you his radar gun or was he just pacing you? I hear if he did have you on radar, he is supposed to show you as proof. You can try fighting it, but beware, if you loose you will probably end up paying more.

ALWAYS FIGHT IT! 100% of the time, coming from someone who has lost thier license 3 times...........all speeding (still paying for all the things i did when i was 18) Even with a horrible record i would get off here and there. Like last year, 2 court dates in one week, at the same courthouse, got off both. =0) WHEW i sweated those ones. Im attempting to clear my record, in massachusetts there is a law called "Clean Slate". If a driver doesnt not have any moving violations in 36 consecutive months, you drop to a step 14. geez maybe then ill stop paying 4400 dollars a year in insurance =0p
If it doesn't kill you.....it only makes you faster!

I was caught last year with lazar gun, i was asked to see the reading...the officer tryed to get the reading..but the reading he got showed 45 (it was a 50 mph zone..and I KNOW i wasn't speeding - cus i was on c.contol). Regardless...the officer proceeded to tell me he doesn't NEED to show this..its under texas law..So its could be a law to show proof where you are at..not everywhere. For me..i choose deffered jurisduction..and got off..with no point nor any hikes in ins. rates..just court costs...thats the ONE good thing about texas...

The up front fine is nothing. What you want to avoid are the points.

In jersey, you get 2 points for 1-15 over and 4 up to 30mph over, and 5 over that.

Also, you can take a driving course (once a year I think) here to get two points off. If it was two points, or whatever the Georgian equivalent is, you can just pay the fine, pay for traffic school, and get the points off.

If its the equivalent of 4 pts here (ie. you can get it off which just driving school) BRING IT TO COURT, no questions. All the courts ive been to have brought down all my 4pt violations down to two, and in one case, no points. Youll always pay more by bring it to court, but you dont want the points since thatll murder you on insurance compared to the one time cost of court + the premium to get the points off.

If the cop doesnt show up, you usually get off free. If the cop does show up, they usually have you talk to the Prosecutor, and basically you work out a deal (Usually, less points, more money). Milage varies from court to court tho. Ive been to court in three different towns (and actually up for another one soon...I know, chillax on the gas), and some are really official, with testimonies and all, and some they just kind of line you up, make a deal, do some procedings to make it official, and then let you go.

Adam Corolla from the Man Show says and I agree, that when you get a ticket, in a way it should be seen as a "bet" between the county and the "violator." If you contest and show up in court and the citing officer doesn't show, then the defendant (you) should be rewarded the amount you would pay if you were found "guilty." But the way it is now if you win you don't really win anything, you just avoid paying the fine and don't receive any retribution for your troubles of contesting the ticket and appearing in court.

This would cause everyone who received a moving violation more of a reason to contest since they could actually get something out of it, which would be good because then cops would only give out tickets they were absolutely certain about, giving them a reason to show in court...the more ticky tacky tickets they hand out the more they would be asked to appear in court.

But since this is not the case, I say pay the fine and go to traffic school

I cried once, and reasoned out of another (I was avoiding an accident). Avoid them in the first place. Don't excessively speed.

If you have prepaid legal you should definately go to court for it. They arrange for you to have a free lawyer to represent you in court and most of the time poeple do get off.
